1. Overview

Welcome to 3 Gals and A Press. The terms “we,” “us” and “our” refer to 3 Gals and A Press. We operate this website and online store to offer printed apparel and related products and services (collectively, the “Services”). Our store is powered by Shopify.

These Terms of Service (“Terms”) explain the rules that apply when you visit our website, place an order or otherwise use our Services. By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2. Eligibility and Account Information

You must be at least the age of majority in your state or province of residence to make a purchase, or you must have the permission and supervision of a parent or legal guardian.

You agree to provide accurate, current and complete information when placing an order or creating an account. You are responsible for protecting your account credentials and for activity conducted through your account.

3. Products and Garment Variations

We make reasonable efforts to describe and display our products accurately. However, colors and details may appear differently depending on your screen, device settings and lighting.

Our designs are printed on garments manufactured by third parties. Garment sizing, fit, fabric, color and construction may vary by brand, style, color and production batch. Slight variations in color, print placement, measurements and appearance are normal and are not necessarily defects.

Please review the product description and our Size Charts and Care Instructions before ordering. We do not manufacture the garments and cannot guarantee that a particular size will fit every customer in the same way.

We may change product descriptions, prices, colors, available sizes or other product details, and we may discontinue products, at any time without notice.

4. Printed-to-Order and Personalized Products

Our garments are printed especially for each customer. Please review your selected product, garment style, size, color, design and personalization carefully before submitting your order.

For personalized or custom products, you are responsible for checking all submitted names, dates, spelling, punctuation, colors and other requested details. If we provide a design proof, production may not begin until the proof is approved. Your approval confirms that the design and information shown are correct.

Changes and cancellations are not guaranteed after an order has entered production.

5. Customer-Submitted Content

If you provide artwork, photographs, logos, names, text or other materials for a custom order, you represent that you own the materials or have permission to use and reproduce them. You may not submit material that infringes another person’s copyright, trademark, privacy, publicity or other rights.

You grant us a limited permission to use the submitted materials only as reasonably necessary to prepare, produce and fulfill your requested order. We may decline or cancel a custom order if we believe the requested content is unlawful, infringing, hateful, threatening, obscene or otherwise inappropriate.

6. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order confirmation only confirms that we received your order; it does not require us to accept or fulfill it. We may decline, limit or cancel an order because of suspected fraud, payment problems, product unavailability, pricing or listing errors, prohibited content or other reasonable business concerns.

If we cancel an order after payment has been collected, we will refund the amount paid for the canceled portion of the order. We will attempt to contact you using the email address, phone number or billing information provided with the order.

Products purchased through our store are intended for personal or household use unless we agree otherwise in writing.

7. Prices, Payments and Promotions

Prices and promotions may change without notice. The price charged will be the price displayed at checkout when your order is submitted, subject to correction of obvious errors. Taxes, shipping and other applicable charges will be shown at checkout when required.

You represent that you are authorized to use the payment method provided and that the billing information is accurate. Promotions may have separate terms. If promotional terms conflict with these Terms, the promotional terms will apply to that promotion.

8. Shipping and Delivery

Processing and delivery dates are estimates, not guarantees. Delays may occur because of production demands, carrier disruptions, weather, incorrect addresses or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. If an order is returned or delayed because the address supplied was incomplete or incorrect, additional shipping charges may apply.

If tracking shows a delivery problem, please contact us promptly so we can review the situation. Nothing in this section limits any rights you may have under applicable law.

9. Returns and Replacements

Because our apparel is printed to order, we do not accept traditional returns or exchanges for a change of mind, color preference, personal fit preference or an incorrectly selected size.

If an item arrives damaged, defective, incorrectly printed, mislabeled or different from what you ordered, please submit our Returns & Replacement Request form within seven days of delivery. You will need your order number and clear photographs showing the entire garment and the problem.

Approved claims will be handled according to our Return Policy. Your rights under applicable consumer-protection law are not limited by this policy.

10. Care of Printed Garments

Customers are responsible for following the care instructions provided on our website and with the garment. Damage caused by improper washing, drying, ironing, bleaching, stain treatment or other care is not considered a manufacturing or printing defect.

11. Intellectual Property

Unless otherwise stated, the website, store design, text, graphics, photographs, product images, original apparel designs, logos and other content provided through the Services are owned by or licensed to 3 Gals and A Press and are protected by applicable intellectual-property laws.

You may use the Services only for personal, noncommercial purposes. You may not reproduce, copy, modify, distribute, sell, publish or commercially exploit our content or designs without prior written permission. Trademarks and copyrighted materials belonging to third parties remain the property of their respective owners.

12. Reviews, Feedback and Submissions

If you voluntarily submit a product review, testimonial, suggestion or other feedback, you grant us a nonexclusive, worldwide, royalty-free license to use, reproduce and display it in connection with operating and promoting our business, subject to applicable privacy and consumer-protection laws.

You represent that your submission is truthful, that you have the right to share it and that it does not violate another person’s rights. We may remove content that is unlawful, abusive, deceptive, infringing or unrelated to our products or Services.

13. Third-Party Services and Links

Our website may use or link to services operated by third parties, including payment processors, shipping providers, social-media platforms and embedded applications. We do not control those third-party services and are not responsible for their independent content, availability or practices. Your use of a third-party service may be governed by that provider’s own terms and privacy policy.

14. Relationship With Shopify

3 Gals and A Press is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and 3 Gals and A Press. Shopify is not the seller of our products and is not responsible for the products, order fulfillment or customer service associated with your purchase.

To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from transactions between you and 3 Gals and A Press. Nothing in this section limits rights that cannot legally be waived.

15. Prohibited Uses

You may not use the Services:

For an unlawful, fraudulent or malicious purpose;
To violate applicable laws or another person’s rights;
To submit infringing, deceptive, abusive, threatening or harmful material;
To introduce viruses, malicious code or other technology intended to disrupt the Services;
To impersonate another person or provide false purchase information;
To collect other users’ personal information without authorization;
To interfere with the security, availability or normal operation of the website; or
To copy, scrape, resell or commercially exploit the Services or their content without permission.

We may restrict or terminate access to the Services if we reasonably believe these Terms have been violated.

16. Errors and Availability

Our website may occasionally contain typographical errors, inaccurate information or omissions involving product descriptions, prices, promotions, shipping charges, transit times or availability. We may correct errors, update information or cancel affected orders. If we cancel an order because of an error after collecting payment, we will issue an appropriate refund.

17. Disclaimer of Warranties

Except for any express promises stated in these Terms or required by law, the Services are provided “as is” and “as available.” We do not promise that the website will always be uninterrupted, secure or error-free.

To the fullest extent permitted by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, durability, title and noninfringement. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, 3 Gals and A Press and its owners, employees, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential damages arising from your use of the Services or products purchased through the Services.

Where liability cannot be excluded, our total liability will be limited to the amount you paid for the product or order giving rise to the claim, unless applicable law requires otherwise. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless 3 Gals and A Press and its service providers from third-party claims, losses or reasonable expenses arising from your unlawful use of the Services, your violation of these Terms or your infringement of another person’s rights, including claims related to customer-submitted content.

20. Governing Law

These Terms are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law principles. Any dispute will be handled in a court with proper jurisdiction, subject to any consumer rights that require a different forum or governing law.

21. Changes to These Terms

We may update these Terms by posting a revised version on this page. Material changes will become effective as required by applicable law. The effective date at the top of the page identifies the latest revision.

22. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. These Terms, together with the policies referenced here, constitute the agreement between you and us regarding your use of the Services.
